Terms and Conditions for Using the Website

Ownership of the domain www.madridblooms.com
In compliance with Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE), we inform you that the ownership of the domain of our school and online store, www.madridblooms.com, belongs to Madrid Flower School S.L., with a registered address at Calle Juan Duque 27, local 1 portal A, Madrid 28005, legally incorporated in Spain with CIF B88350822 and registered in the Mercantile Registry of Madrid on 24/04/2019, registered in Sheet M-693131 of Volume 39007, Book 0, Folio 80 (hereinafter MADRID BLOOMS). Purpose and scope of application

These General Conditions of Contracting and Use regulate the provision of information available on MADRID BLOOMS and online store and the commercial transactions that arise between MADRID BLOOMS and users of the domain www.madridblooms.com. Both browsing through the school and online store and the acquisition of any products offered therein imply acceptance by the user, without reservation of any kind, of each and every one of these general conditions of contracting and use. MADRID BLOOMS may modify the website to make any changes and modifications it deems appropriate and necessary for its proper functioning, without prior notice.

Information provided on the website

We make every effort to provide accurate information on the website and avoid typographical errors. All contractual information presented on www.madridblooms.com is in Spanish, and communication with customers and users, as well as the formalization of contracts, will be conducted in this language.

However, we can respond to inquiries in English, Portuguese, and French.

Intellectual and industrial property

All content published on the school, especially photographs, designs, texts, graphics, logos, icons, buttons, as well as software, trade names, trademarks, or industrial designs, and any other signs capable of industrial and commercial use are subject to intellectual and industrial property rights of MADRID BLOOMS or third parties who have duly authorized their inclusion on the website.

Under no circumstances will it be understood that any license is granted or any waiver, transfer, total or partial assignment of such rights is made, nor is any right or expectation of rights conferred, especially with regard to alteration, exploitation, reproduction, distribution, or public communication of such contents without the prior express authorization of MADRID BLOOMS or the corresponding owners.

Therefore, the use of the MADRID BLOOMS website for public or commercial purposes is prohibited, and the content of the website may not be exploited, reproduced, distributed, modified, publicly communicated, transferred, transformed, or used. The introduction of hyperlinks for commercial purposes on websites outside of MADRID BLOOMS , which allow access to our website, is expressly prohibited without prior consent.

Responsibility of MADRID BLOOMS

The courses and products presented on the website comply with Spanish legislation. MADRID BLOOMS cannot be held responsible for courses and products that do not comply with the legislation of countries to which they may have been directed or sent based on customer orders. Therefore, customers outside of Spain are responsible for verifying the possibility of receiving, importing, or using the courses and products they request from us.

Access to the website is voluntary and, therefore, the responsibility of the user, who will be responsible for any direct or indirect effects resulting from their use of the website or telephone service, including, illustratively and not limitatively, any adverse economic, technical, and/or legal consequences, as well as disappointment with expectations generated by our website. The user agrees to indemnify MADRID BLOOMS for any claims arising directly or indirectly from such acts.

MADRID BLOOMS is not responsible for damages that may arise from interferences, omissions, interruptions, computer viruses, breakdowns, and/or disconnections in the operational functioning of this electronic system or in the computer equipment and systems of users, caused by reasons beyond MADRID BLOOMS’s control, which prevent or delay the provision of services or navigation on the website, nor for delays or blockages in use caused by deficiencies or overloads in the Internet or other electronic systems, nor for the impossibility of providing the service or allowing access for reasons not attributable to MADRID BLOOMS, due to the user, third parties, or force majeure situations. MADRID BLOOMS does not generally control the use that users make of the website.

In particular, MADRID BLOOMS does not assume any responsibility for users using the website in accordance with the law, these General Conditions, morality, and generally accepted good customs and public order, nor for doing so diligently and prudently.

Obligations of customers and users

In general, the user undertakes to comply with these general conditions, as well as to follow the specific warnings or usage instructions contained therein, on the website, and always act in accordance with the law, good customs, and the requirements of good faith, exercising due diligence, and refraining from using the website in any way that could hinder, damage, or impair its normal operation, the assets or rights of MADRID BLOOMS, its suppliers, other users, or in general any third party.

Access and use of the portal by minors without the express consent of their parents is prohibited. MADRID BLOOMS is not responsible for the accuracy and correctness of the data filled in by the user and therefore cannot verify their age. Specifically, and without implying any restriction to the previous section, during the use of the website www.madridflowerschool.com, the user agrees to:

a) Provide truthful information about the data requested in the user registration form or when placing an order, and keep it updated.

b) Not introduce, store, or disseminate on or from the website any information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence, discrimination based on race, sex, ideology, religion, or that in any way violates morality, public order, fundamental rights, public liberties, honor, privacy, or image of third parties and, in general, current regulations.

c) Not introduce, store, or disseminate through the store page any program, data, virus, code, or any other electronic or physical device that could cause damage to the website, any of the services, or to any equipment, systems, or networks of MADRID BLOOMS, of any other user, MADRID BLOOMS suppliers, or in general any third party.

d) Diligently guard the “username” and “password” provided by MADRID BLOOMS, assuming responsibility for any damages and losses that may arise from misuse of them.

e) Not carry out advertising or commercial exploitation activities through the website, and not use its content and information to send advertisements or messages for any other commercial purpose, or to collect or store personal data of third parties.

f) Not use false identities or impersonate others in the use of the website or in the use of any of its services, including, where applicable, the use of passwords or access keys of third parties or in any other way. Such access may only be used by the user exclusively.

g) Not destroy, alter, use for their own purposes, disable or damage the data, information, programs, or electronic documents of MADRID BLOOMS, its suppliers, or third parties.

h) Not introduce, store, or disseminate through the website any content that infringes the intellectual property, industrial property rights, or trade secrets of third parties, nor in general any content for which it does not have, in accordance with the law, the right to make it available to a third party.

Important: The customer agrees to enable the delivery of the requested order by providing their telephone number, a postal delivery address, and an email address where the requested order can be delivered within the usual delivery hours. In case of non-compliance by the customer with this obligation, MADRID BLOOMS will have no responsibility for the delay or impossibility of delivery of the requested order.

Communication and security

Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol, encrypting data sent through the RSA encryption system, so that no one can appropriate them as they do not have the necessary key.

Shipping costs

Shipping and/or handling costs are included in the price for Spain and Portugal. However, if your purchase goes beyond the Iberian Peninsula, please contact us at hola@madridblooms.com.

Due to the perishable nature of flowers and the transport and customs restrictions, we do not ship flower boxes to the Balearic Islands, Canary Islands, Melilla, or Ceuta.

Sales and goods delivery policy

The courses and products sold through the website must be paid for through our payment gateway with credit cards and/or PayPal.

For the Online Professional Floral Design Program and Saturday Flowers Online courses, a pre-registration payment must be made to secure a place. The rest of the workshops must be paid in full to reserve a place.

MADRID BLOOMS undertakes to deliver the course and/or product offered on the website on the scheduled date, unless the course does not reach the minimum number of students and is canceled by MADRID BLOOMS.

MADRID BLOOMS uses the services of external providers for the transport of its products. If, due to mishandling within Spain and Portugal, the product arrives in conditions that make it unusable, and this is verified with photographs sent on the same day of its arrival, MADRID BLOOMS undertakes to replace it. Therefore, it is essential to contact MADRID BLOOMS on the same day of delivery. After that day, the product will not be replaced.

TERMS AND CONDITIONS FOR IN PERSON CLASSES

Requirements

Due to the tools used in our school, attendees must meet the following requirements:

The minimum age is 18 years.

It is important to wear comfortable clothing and closed-toe shoes.

During classes, students are expected to behave correctly and respectfully towards the instructor and/or designer. If this behavior is not maintained, the student will be warned. If the expected conduct parameters are not met, we reserve the right to cancel their enrollment without a refund.

Language

Afternoon workshops are conducted in Spanish.

Within the MADRID BLOOMS team, we have instructors who speak English, French, and Portuguese.

Courses are personal and non-transferable.

Photographs and Videos

MADRID BLOOMS takes photographs and videos of students and their work for publication on our website and social media.

If you do not want your image published, please email hola@madridblooms.com

Students may take as many photographs as they wish during classes. However, videos are not authorized.

After completing the design, students may record videos of their finished work.

During International Workshops, there will be photography sessions, and these will be sent to students a few days after the workshop ends.

Payment Policy

The full amount for the Professional Program must be paid one month before its start date. This also applies to one-week or longer cycles.

International Workshops, Master Classes, and Online Workshops must be fully paid one month before the course begins.

Courses are priced in Euros € and must be paid in this currency. Course prices include VAT. For information on Cancellations and Refunds, please read below.

Payment Methods

Course payments are made through our website using credit cards.

If you prefer to pay by bank transfer, our information is: Madrid Flower School S.L. IBAN ES71 0081 7112 8100 0256 3261, BIC BSABESBB. You must provide proof of the transaction with the course name and date to hola@madridblooms.com. Only this proof can confirm your status as a student.

Certificates

MADRID BLOOMS issues a Floral Designer Certificate (diploma) to students who have an 85% attendance in the Online Professional Floral Design Program or Saturday Flowers Online.

Gift Card

The gift card can be used as payment or credit for any school workshop, provided it is used with a minimum of 10 days’ notice. It is personal and non-transferable. It is valid for one year from the date of issue, non-refundable, and is sent via email to the gift recipient.

If you wish to have it printed on paper, accompanied by a mini bouquet of flowers, and delivered by bicycle, there is an additional charge of €60. (Only valid in the Community of Madrid).

Force Majeure Events

MADRID BLOOMS is not responsible for force majeure events that prevent the total or partial execution of its courses. This includes strikes of all kinds, terrorist acts, wars, rebellions, looting, theft, fires, earthquakes, storms, floods, natural disasters, air accidents, or other events such as general cuts in electricity, water, and internet services, equipment malfunctions in heating and air conditioning, disease outbreaks, epidemics, and pandemics, public street interruptions preventing school access, and governmental, regional, and Madrid Community regulations, among others.

Cancellation/Refund Policy

Cancellation by the Student

a. You may cancel your place in a course up to one month before its start date. Under these circumstances, you are entitled to a full refund of the course fee, less any deposit required to reserve your course, if applicable.

b. If you wish to cancel within one month of the course start date, you are not entitled to a refund.

c. If you have booked a course of one, two, or three weeks in duration and wish to cancel within one month from the course start date, you are not entitled to a refund. However, at our discretion and subject to availability, you may use the course fee as credit towards a future course.

d. If you have booked a course within one month of its start date, conditions b apply.

e. Cash reservation refunds can only be made via bank transfer.

f. We do not offer refunds for travel or accommodation expenses incurred as a result of booking an MADRID BLOOMS course.

g. If you are denied entry into Spain, you are not entitled to a refund of the course fees.

h. If you require a visa to enter the UK and your visa is delayed, you are also not entitled to a refund of the course fee. However, at our discretion, we will consider transferring it to another course at a later date.

Please note that refunds may take up to three weeks to process.

Cancellation by MADRID BLOOMS

a. Please note that courses have a minimum attendance level and may be canceled if few reservations are received. We reserve the right to modify or cancel courses.

b. The fee paid for registration for one or more Cycles or the entire Professional Program, whether in Spanish or English, will not be refunded if the reason for cancellation is events beyond MADRID BLOOMS’s control. This includes strikes of all kinds, terrorist acts, wars, rebellions, looting, theft, fires, earthquakes, storms, floods, natural disasters, air accidents, or other events such as general cuts in electricity, water, and internet services, equipment malfunctions in heating and air conditioning, disease outbreaks, epidemics, and pandemics, public street interruptions preventing school access, and governmental, regional, and Madrid Community regulations, among others.

c. If we cancel a course, we will try to notify you at least one week in advance. You will have the option to change to another course or request a refund of the fee minus the registration fee for one or more Cycles or the entire Professional Program (explained in point b), which will be refunded within three weeks.

d. We will not be liable for any loss (including but not limited to travel and accommodation costs) arising from any modification or cancellation of courses or schedule limitations as previously established, beyond the course fee.

Non-Attendance

If you are unable to attend one or more classes due to illness or personal or professional reasons, you are not entitled to a refund, extra enrollment, or automatic transfer to another course. However, we will consider such actions as fair and reasonable.

Please note that additional charges may apply if alternative options are offered.

Gift Cards

MADRID BLOOMS gift cards can be purchased online and are sent directly via email to the purchaser.

MADRID BLOOMS gift cards are issued in Euros and can only be redeemed online for MADRID BLOOMS courses.

The gift card is valid for 12 months from the date of purchase.

The MADRID BLOOMS gift card is non-refundable and cannot be exchanged for cash/credit, and cash/credit refunds will not be available for purchases made with the voucher.

MADRID BLOOMS gift cards are redeemable only for MADRID BLOOMS courses.
